Drake Accused Of Using Uncleared Sample On “Pound Cake,” Sued For $300K

Drake is being sued for some $300K for using a sample of jazz musician Jimmy Smith on Nothing Was The Same track “Pound Cake/Paris Morton Music 2,” according to TMZ. Before the beat drops in on the seven-minute double track, there’s a 35-second spoken word intro from the 1982 track “Jimmy Smith Rap” — and the interesting thing is that the liner notes for Drake’s album indicate the snippet was licensed (“Featuring samples of the Jimmy Smith recording ‘Jimmy Smith Rap’ produced under license from Atlantic Recording Corp., by arrangement with Rhino Entertainment Company, a Warner Music Group Company.”).

But Smith’s estate claims that not only was Drake never given permission to use the content, but that his camp never even asked. So it’s either blatant stealing or just a case of wires getting crossed at the labels’ legal departments. Either way, the estate is suing Drake and Cash Money for over $300,000.
