Kesha Suffers Another Legal Setback: NY Judge Tosses Various Claims Against Dr. Luke

New York Supreme Court Justice Shirley Kornreich, who in February denied Kesha the injunction she was seeking to free herself of the contract binding her to Dr. Luke and Sony’s Kemosabe Records, dealt another setback to the 29-year-old pop singer today (April 6). The judge has examined Kesha’s allegations accusing Dr. Luke, whose real name is Lukasz Gottwald, of drugging and raping her in 2005 and committing ongoing abuse, notes The Hollywood Reporter. Kornreich determined that several of Kesha’s discrimination claims aren’t legitimate because of lack of jurisdiction, while other claims simply don’t add up.

“Every rape is not a gender-motivated hate crime,” Kornreich wrote after considering Kesha’s assertion that Dr. Luke violated New York statutes commonly referred to as “hate crime” laws. The judge noted that the facts as they have been submitted by Kesha’s team don’t add up to the allegation that the music producer harbored animus towards women.

Per The Hollywood Reporter, Kornreich added that such a claim can’t be based on abusive remarks and threats made over a ten-year period. Rather, there needs to be physical violence or property damage.

Kesha’s allegation that Luke assaulted her on an airplane and raped her in a hotel before 2008 is the only one Kornreich deemed to fit the criteria, but the claim came after the five-year statute-of-limitations. Thus, “the claim is time-barred,” stated Kornreich.

As for a claim of intentional infliction of emotional distress, the judge reportedly wrote that “insults about her value as an artist, her looks, and her weight are insufficient to constitute extreme, outrageous conduct intolerable in civilized society.”

Obviously, none of this plays out well for Kesha with regards to the claims she filed in the New York jurisdiction. In February, Vanity Fair noted that a phone-conference appearance for Gottwald’s countersuit against Kesha is scheduled to happen on May 5 in New York, while Kesha’s next scheduled court date is May 16 in Los Angeles, when a judge is to be updated on how the New York case is proceeding.
